Support payments paid by one spouse to the other are divided into two categories:
- Post separation support, which is temporary in nature
- Alimony, which is more permanent
Alimony might be paid in periodic payments, indefinitely or for a set time, or paid in one lump sum. The basis of both post separation support and alimony is the needs of the dependent spouse and the supporting spouse's ability to pay. If the parties meet these initial standards, the judge can consider other financial factors or marital misconduct in deciding whether post separation support or alimony should be awarded, and if so, in what amount. A judge has great discretion in this area and the circumstances of each marriage will play a large part in a judge's decision whether to award support payments and the amount of any support.
