Automobile AccidentsAccording to NHTSA, each year there are more than 6 million automobile accidents. More than 3 million people are injured and more than 40,000 people are killed. One has a claim for bodily injury when it can be shown the injury was sustained as a direct and proximate result of the negligence of another. We have actionable negligence when it can be shown there is a duty on the part of a person and he or she has breached that duty by either doing something which should not have been done or has failed to do something which should have been done in furtherance of that duty and as a direct a proximate result another is damaged. This can be in the form of bodily injury or property damage.
Property DamageProperty damage arising from someone else's negligence is recoverable to the extent of the damage which is usually measured by what it cost to repair the damaged property. If the property is a total loss the negligent party is responsible for the fair market value of the damaged property just prior to the damage occurring. There may also be a question of whether the property has depreciated as a result of the damage even though it may have been repaired. Insurance companies do not like to pay depreciation and one usually has to really fight to get such payments. |
