Personal injury is the term which has come to be used most often for describing cases which involve personal injury resulting from someone else's negligence. In the law this situation is known as a Tort which is defined as "a civil wrong, not under contract, for which the law provides a remedy." Today this most commonly arises in automobile accidents, slip and fall cases and malpractice cases. There are many factors which must be examined in order to determine if one has a valid and actionable claim for personal injury and these factors are sometimes very complex. An injured person is entitled to recover money for medical expenses incurred for injury treatment, pain and suffering and lost income. There are also insurance issues to be dealt with to determine if funds are available to compensate the victim and in what amount these funds are available. Personal injury cases sometimes have accompanying property damage issues, such as damaged automobile in an automobile accident.
