There are many things one must consider when preparing a Will and Estate Planning.  Getting legal advice is a must. Wills should only be prepared by attorneys familiar with the laws controlling the transfer of property at death. Unwanted results can occur as the result of one word being used as opposed to another.

In some situations, Trusts may be needed.  Trusts help to accomplish the results desired both in the way of disposition and protection of assets for tax avoidance. Consideration may also be needed for the appointment of a guardian.

If one does not properly prepare a Will, their property will pass in accordance with the laws of intestacy as set forth in the general statutes of the state of jurisdiction. This might not correspond to the wishes of the deceased individual.
